Terms of Use

These Terms of Use (“Terms”) govern your use of the website at abrilliantmind.net (“the Site”), operated by Michelle Mohlman, doing business as A Brilliant Mind (“we,” “us,” “our”). By using the Site you agree to these Terms. If you don’t agree, please don’t use the Site.

1. About the Site

The Site is an informational marketing site for a personal, in-person dyslexia tutoring practice in Utah County, Utah. It exists to describe our services, share our credentials, and let parents contact us about tutoring for their children.

2. Not medical or educational advice

Nothing on this Site is medical advice, clinical diagnosis, or educational assessment. Dyslexia and related learning differences are best identified through a formal evaluation by a licensed professional (a licensed psychologist, educational diagnostician, or qualified school district team). Content on this Site — including FAQ answers, descriptions of methods, and our “how do I know if my child has dyslexia” guidance — is general information to help parents think about next steps. It is not a substitute for professional evaluation or treatment, and reading this site does not create a tutor–student, clinical, or professional relationship between you and us.

3. Using the Site

You may read, share links to, and print reasonable portions of the Site for your own non-commercial use. You may not:

• Republish the Site’s content (in whole or in part) on other websites or in other publications without our written permission.
• Remove or modify copyright, trademark, or attribution notices.
• Use automated tools to scrape the Site, attempt to bypass security (including the Cloudflare Turnstile challenge on our contact form), or overload the Site with requests.
• Submit false, misleading, or abusive information through the contact form, or use the form for anything other than a good-faith inquiry about tutoring services.

4. Content ownership

Unless otherwise noted, the text, images, and design of the Site are either owned by us or used with permission. “A Brilliant Mind” (wordmark and name) is a business identifier used by Michelle Mohlman. Font software and third-party components used to build the Site remain the property of their respective owners.

Your submissions through the contact form remain yours, but by submitting them you give us permission to use them as described in the Privacy Policy — specifically, to respond to your inquiry.

5. Third-party services

The Site is hosted by Cloudflare, uses Cloudflare Turnstile for bot protection, uses Cloudflare Web Analytics for cookie-free traffic statistics, and uses Resend to deliver email from the contact form. Those services have their own terms and privacy policies. We are not responsible for the content, availability, or practices of any third-party service.

Any external links on the Site are provided as a convenience. Following an external link takes you off the Site and onto a page we don’t control.

6. Scheduling, rates, and payment

Rates, session length, and scheduling described on the Site are subject to change. Nothing on the Site is an offer or a binding commitment to provide services. Any actual tutoring relationship — including rates, scheduling, cancellation rules, and any other terms — is governed by a separate agreement between the parent/guardian and A Brilliant Mind, reached after an initial consultation.

7. No warranty

The Site is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, about the Site and its content — including warranties of accuracy, completeness, fitness for a particular purpose, uninterrupted availability, and absence of errors or viruses. We don’t promise that the Site will always be reachable, that links will always work, or that information on the Site is current at any given moment. Use of the Site is at your own risk.

8. Limitation of liability

To the fullest extent allowed by law, A Brilliant Mind and Michelle Mohlman will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Site — including loss of data, lost profits, or emotional distress — even if we’ve been told such damages are possible. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars ($100.00).

Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnity

You agree to defend, indemnify, and hold harmless A Brilliant Mind and Michelle Mohlman from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

10. Governing law and venue

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to personal jurisdiction there.

11. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Site after an update means you accept the revised Terms.
